I don't doubt that the more far-reaching decisions contemplated under a Biden Board would run into trouble with Trump's judges. But I believe that situation is better than the alternative of unilateral disarmament.
I'm a little confused--has the union announced that they intend to try and officially bargain for the minority membership? My impression from the NYT was it's more of a solidarity union / public protest / pressure campaign sort of thing. Is this just a hypothetical or do they intend to collectively negotiate a contract?

I think you're right as to the Google workers' current plans, but I'm taking their stated label of "minority union" at face value since that concept does have historical meaning and they are affiliated with an international union that has experience with it. If bargaining is truly never in the cards, then this article can be seen as merely using the event as a discussion point.

If the Board favors majority unionism it could clean up the process to increase the liklihood of more elections and more bargaining in cases where unions win elections.

I read the NYT article the same way. I think this is an interesting hypothetical and I'm sure they haven't ruled out pursuing bargaining.
